What follows outlines the contract with lonely.ie and you. The terms include rights and requirements between users and New Media Lotteries which operate and manage lonely.ie. This includes all services, productions and third party partners and all communications between said parties.

1.1 This page states the "Terms & Conditions of Use" under which Members and users (collectively "Users") may use www.lonely.ie, and or any other websites under lonely.ie's control (whether partial or otherwise)(the "Website").
1.2 Access to this Website and the use of services (if any) or information on it is subject to these Terms & Conditions of Use. You should carefully read these Terms & Conditions of Use. By accessing this Website and or proceeding further, you will be deemed to have accepted them.
1.3 Lonely.ie is for adults of over 18 only. By signing up as a user you are confirming your age with us and confirming that you can enter into contract with lonely.ie and agree to abide with the terms and conditions. Lonely.ie can reserve the right to 'take down' any profiles that it believes do not abide by the Terms and Conditions of Use set out relating to age qualification of the site until a identify of age is proven by users. For verification purposes lonely.ie reserves the right to require production and proof of age, which may include producing your passport and or driving licence to us, and which you agree to do as part of your membership agreement and or your application to become a member.
2 Definitions
In these Terms & Conditions of Use, the following terms shall have the meanings indicated:-
"Members" means members and potential members who wish to access the Website(s) of lonely.ie, to become a member, to place or access profiles, advertise and or view service offerings;
"lonely.ie" means Lonely.ie which is owned and operated by New Media Services, 22-23 Upper Pembroke Street, Dublin 2, Ireland;
"Privacy Statement" means our statement of practice as regards the privacy and security of your information when accessing and/or using this Website and any of the feature hereon;
"Terms and Conditions of Use" means these Website Terms and Conditions of Use and any other rules and policies of lonely.ie, including Privacy Statement, Member application terms, purchasing terms, as same may be amended and or replaced from time to time by lonely.ie at lonely.ie's sole and absolute discretion;
"you" means any and all persons accessing or using this Website and/or availing of any information and/or services available on or via this Website;
"we" and "our" and "us" means lonely.ie.
3 Membership
3.1 When you join lonely.ie you become a member of lonely.ie and agree to abide by the terms and conditions. You will be sent an email to verify your email address before your profile is activated and your membership accepted. By verifying your email address you are agreeing to lonely.ie sending you a weekly email containing products, content, and third party offers. You are also agreeing to receive one free weekly text from lonely.ie on behalf of third party suppliers advertising a product or offering. Both of these services are free to the member of lonely.ie and they are obliged as part of membership to receive them. You may cancel your membership to the Website at any stage and delete your profile by emailing support@lonely.ie
3.2 We reserve the right to introduce new services and facilities and also to introduce a cost for use of additional facilities, capabilities and functionality on the Website.
3.3 You are solely responsible for the content that you place on your profile and publish and post or send to other members. We reserve the right to edit, suspend, take down, delete and or ban user submissions or any user that post potentially harmful content or content that does not comply with the Terms and Conditions of Use.
3.4 For your safety please do not post your address or telephone or mobile phone contact number on lonely.ie, you may however post your email address.
3.5 You agree not to post, publish or upload or email any content that is unlawful, defamatory, or libelous. Lonely.ie reserves the right to refuse profiles and/or photographs that it feels are not appropriate for the Website.
4 Permitted Use of the Website
4.1 You agree to use the Website only for lawful purposes in accordance with these terms and conditions.
4.2 You undertake to ensure that all information, content and photographs which you supply is true, and or your own, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not illegal, unlawful, offensive or in breach of any applicable legislation, including infringement of any third party intellectual property rights.
4.3 You confirm that you understand and acknowledge that lonely.ie has not taken steps to verify the identity or details about any of the person whose information appears on the Website.
4.4 Lonely.ie does not guarantee to monitor communications made via the Website. You agree that you are responsible for all communications you enter into and for any consequences thereof. We strongly advise against giving personal contact details (such as private telephone, mobile phone and addresses) to other users of the Website in any communications made via or in consequence of use of the Website.
4.5 You agree to use any chat room, email, advice facility, or message board (if any) available on or via the Website only to send and receive messages and material that is legal and which is not obscene or inappropriate.
4.6 You warrant that you are at least 18 years old or the appropriate legal age where 18 is not the age of majority.

In the event that you are in breach of any terms and obligations lonely.ie may in its absolute discretion suspend your access to the Website and refuse to permit you to use it in future.
4.10 You hereby indemnify upon demand lonely.ie for all costs, claims, liabilities and expenses (including legal expenses) whether direct or indirect which it may suffer as a result of your breach of any of the terms these Terms and Conditions of Use.
4.11 Lonely.ie reserves the right to edit any personal details you submit to the Website whether by editing, cropping, re-sizing or otherwise.
4.12 By posting communications to the Website, you automatically grant, and you represent and warrant that you have the right to grant lonely.ie and it's members a royalty-free, perpetual, irrevocable, non-exclusive license to exploit, use, copy, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed. If you provide lonely.ie or any of it's members with your email address via a registration process or post it on the Website you thereby authorize lonely.ie and it's affiliates and any entities lonely.ie becomes involved with or merges with, the right to use and/or sell your valid email address for any marketing programs or communications with you.
4.13 (Where applicable) you warrant that if you upload a sexually explicit image to the Website and that any images uploaded or submitted are your own.

8.2 Lonely.ie does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by Users or endorse any opinions expressed by Users. Users acknowledge that any reliance on material posted on or via any Lonely.ie Site will be at the User's own risk.
8.3 Lonely.ie acts as a passive conduit for the online distribution of profile information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted or supplied by users or third parties particularly where located abroad. If notified by the User or any other user of communications which allegedly do not conform to these Terms & Conditions of Use or, with respect to non-member users of any Lonely.ie Site, which do not conform to the terms of use applicable to the public access areas of any Lonely.ie Site (if any), lonely.ie may investigate the allegation and determine in its sole discretion whether to remove or request the removal of the communication. Lonely.ie has no liability or responsibility to Users or other users for performance or nonperformance of such activities. 9 Registration and Password
Users are responsible for maintaining the confidentiality of their information and password(s). Users shall immediately notify lonely.ie of any unauthorised use of any password of which Users become aware. Lonely.ie reserves the right to cancel such password and issue a new password in lieu thereof. Lonely.ie reserves the right to periodically change issued passwords.
10 Registration (and Payment) (If any)
10.1 Upon registration with lonely.ie you may:
10.1.1 Register for free (trial) membership, which entitles you (subject to compliance with these Terms and Conditions of Use) to use those areas of the Website available to such members as shown from time to time on the Website; or
10.1.2 Pay an upgrade fee (if any), which, subject to your payment being accepted and maintained and to compliance with these terms and conditions, will enable you to use those areas of the Website available from time to time to such upgraded members (if any).
10.2 The upgrade fee and the length of upgrade referred to herein are as advertised on the Website from time to time. Lonely.ie reserves the right to alter or introduce a fee and amend the services available to subscribed members at any time.
10.3 We reserve the right to introduce a cost for use of additional facilities, capabilities and functionality on the Website.
11 Offers and Promotions
11.1 Lonely.ie reserves the right to modify or withdraw any competitions and/or special offers associated with lonely.ie and/or the Website at any time without prior notice.
11.2 The decision of lonely.ie is final in all matters.
11.3 We may advertise or offer third party products or services.
12 Notify and Take Down Policy
12.1 Lonely.ie does not monitor the Website but it shall retain the right at all times to refuse to publish and/or to take down any personal details submitted by a user and/or any message or notice posted to the Website where it reasonably believes that the message or notice is incorrect, deliberately misleading, illegal, illicit, obscene, defamatory, infringing of third party rights or is likely to harm the reputation of lonely.ie.

13.2 Lonely.ie reserves the right at all times to disclose any information necessary to satisfy any applicable law, regulation, legal process, police request or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, for any reason whatsoever, in lonely.ie's sole discretion.
14 Lonely.ie's Liability

Members are solely responsible for assessing their requirements and each and every profile which may be located or accessed by them (if any). Members are also solely responsible for formulating and accurately formulating their requirements to lonely.ie. Lonely.ie is not involved in the actual contact between Members. Lonely.ie has no control over the quality, safety, legality, planning, satisfaction for use or requirements or the truth or accuracy of any profiles, statements, recommendations or details furnished. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, local laws and regulations, underage persons or people acting under false pretenses. Members assume all risks associated with dealing with other users with whom Members come in contact through any Lonely.ie Site.
14.2 Because user authentication on the Internet is difficult, lonely.ie cannot and does not confirm that each User or Member is who he, she or it claims to be.
